What this page covers

This page (the “Terms”) governs your visits to solsticesunsports.com (the “Site”) and each purchase made there. Solstice Sun LLC (“we”, “us”, “our”) runs the Site and trades as Solstice Sun Sports.

Using the Site or buying from us means you accept these Terms and our Privacy Policy. Anyone who does not accept them should stop using the Site.

Age to order

Orders must be placed by an adult (18, or the age of majority in your state); a parent or guardian can order for someone younger and accepts these Terms on their behalf. We sell to customers for their own use and deliver only within the contiguous United States.

Products and descriptions

We try to describe every product accurately, including its size, weight, materials and what is included. Photos are rendered to show the product clearly, and colors can look slightly different on different screens. Dimensions and weights are nominal and can vary a little from one unit to the next.

If a product you receive does not match its description, your remedy is to return it under our returns policy, or to contact us about a damaged or wrong item as described there.

Prices and availability

Prices are shown in U.S. dollars, and the total you pay is shown at checkout before you place your order. Standard shipping within the contiguous United States is free. We can change prices and the range we carry at any time, but a change does not affect an order we have already accepted.

Everything is sold subject to stock. Despite our care, a price or description on the Site may occasionally be wrong. If we find an error in the price of an item you have ordered, we will tell you and give you the choice of confirming the order at the correct price or cancelling it. If we cannot reach you, we will cancel the order and you will not be charged for it, or we will refund any amount already charged.

Orders

Placing an order is your offer to purchase what is in your cart at the listed prices. The email we send when you place an order confirms that we have received it; it is not yet our acceptance. Our acceptance happens at dispatch. We may decline or cancel an order, in whole or in part, for example if a product is unavailable, if there is an error in the order, or if we suspect fraud. Should we cancel once a charge has gone through, the whole amount goes back to the original payment method.

Every order is a one-time purchase. There are no subscriptions, memberships or automatic reorders, and no card is kept on file for later charges.

Payment

Pay by Visa or Mastercard. No subscriptions or memberships. Your card is charged once, in U.S. dollars, for the total shown at checkout.

Payments in our online store are handled by Woosa Payments, the payment platform of Woosa B.V. (KvK 71751513, Zwolle, the Netherlands). Payment processing and settlement are carried out in partnership with Adyen N.V., a payment institution licensed and supervised by De Nederlandsche Bank. Your payment details are entered on a secure payment form, are used only to carry out the payment, prevent fraud and meet legal obligations, and are not stored by us. See a charge from us that you cannot place? Write to support@solsticesunsports.com with its date and amount before going to your bank, and we will look into it straight away.

Shipping and delivery

Shipping costs nothing to any address in the contiguous United States. Your parcel leaves our warehouse with USPS or UPS inside 2 business days, then spends 3 to 7 business days on the road. We cannot send parcels outside the United States.

Delivery times are estimates. Ownership of the goods, and responsibility for them if they are lost or damaged, moves to you at the moment the carrier drops them at the address on your order. The details, including tracking and what to do about a late or damaged package, are on our shipping page.

Returns and refunds

Anything unused and still in its original packaging can come back. Write to support@solsticesunsports.com within 30 days of delivery to request the return, and we will reply with an authorization and the address to send it to. Return postage is on the customer. Once the parcel reaches us, the money goes back to the original payment method within 5 business days.

Training and outdoor use

Exercise, running, hiking and camping carry risks, including the risk of injury. By using products bought from us, you accept those risks. In particular:

• Load and anchor it right. Weights, bands and pull-up bars are made for one job each. Keep to that job, follow the instructions and warnings in the box, and leave the product as it was made.
• Check it before every session. Look over straps, seams, poles, handles and fixings each time, and retire anything that is frayed, split, bent or coming loose.
• Keep kit away from small children. None of this is a toy. Children should train only with an adult nearby, and weights, bands and pull-up bars belong somewhere young children cannot reach.
• Set up with care. Mount, pitch, anchor or assemble products as their instructions describe, on a surface or structure suited to them, and check them again before you put your weight on them.
• Know your limits. Talk to a doctor before starting a new exercise routine, and stop if you feel pain, dizziness or shortness of breath.
• Plan for the outdoors. Check the weather, conditions and local rules before you head out, and carry what you need for the trip you are taking.

Nothing on the Site is medical, fitness or safety advice, and product descriptions do not replace the judgement of the person using the product.

Disclaimer of warranties

Our returns policy and our process for items that arrive damaged or wrong are described on our Returns page. Beyond that, and to the fullest extent permitted by law, the Site and all products are provided “as is” and “as available”, and we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Some states do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you. In that case, any implied warranty is limited to the shortest period the law allows.

Limitation of liability

As far as the law allows, neither Solstice Sun LLC nor its members, managers, staff or suppliers will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or loss of use, arising out of or relating to the Site, these Terms or any product, even if we have been told such damages are possible.

If we are found liable in connection with a product or an order, the most we will owe is what you paid us for it. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, or for fraud.

Indemnity

Where the law permits, you will indemnify and hold harmless Solstice Sun LLC against any claim, loss or expense, reasonable attorneys' fees included, that results from you breaking these Terms or misusing the Site or a product.

Using the Site

You agree not to:

• use the Site for any unlawful purpose or to place fraudulent orders,
• buy products for resale without our written agreement,
• copy, scrape or harvest content or data from the Site by automated means,
• interfere with the security or operation of the Site, or try to reach parts of it not meant for you.

We may suspend access to the Site or cancel orders where we reasonably believe these rules are broken.

Our content

The words, photographs, graphics and logos on the Site, and the Solstice Sun Sports name itself, are owned by Solstice Sun LLC and protected by intellectual property law. Feel free to read, save or print pages for yourself; anything beyond that requires our permission in writing.

Privacy

Our Privacy Policy explains what information we collect when you use the Site or place an order, and how we use and protect it.

Links to other websites

The Site may link to websites we do not operate, such as a carrier's tracking page. We are not responsible for their content, products or privacy practices, and a link is not an endorsement.

Governing law and disputes

These Terms and any dispute arising from them, from the Site or from a purchase are governed by the laws of the State of Utah and applicable federal law of the United States, without regard to conflict of laws rules.

If you have a problem, please email support@solsticesunsports.com first. Most concerns can be settled quickly this way, and we ask that both sides try in good faith for 30 days before starting a formal claim.

Any claim that is not resolved informally must be brought in the state or federal courts located in the State of Utah, and you and we consent to their jurisdiction. A claim small enough for small claims court may be filed there individually by you or by us. Nothing in this section takes away rights you have under the consumer protection laws of the state where you live.

Changes to these Terms

When these Terms change, the revised text replaces this page. Each order is governed by the text that was live when you placed it. Continuing to use the Site after a change means you accept the updated Terms.

General

This page, read with our Privacy Policy and our shipping and returns policies, sets out everything you and we have agreed about the Site and your purchases. A court striking down one provision leaves every other provision standing. If we do not enforce a provision straight away, we have not waived it. You may not transfer your rights under these Terms; we may transfer ours to a successor business. We are not responsible for delays caused by events outside our reasonable control, such as severe weather or carrier disruption.
